{"id":30526,"date":"2025-09-08T12:29:14","date_gmt":"2025-09-08T10:29:14","guid":{"rendered":"https:\/\/www.bacciardipartners.it\/?p=30526"},"modified":"2025-10-03T16:07:47","modified_gmt":"2025-10-03T14:07:47","slug":"unlawful-dismissals-in-small-businesses","status":"publish","type":"post","link":"https:\/\/mail.bacciardipartners.it\/en\/unlawful-dismissals-in-small-businesses\/","title":{"rendered":"Unlawful dismissals in small businesses: the Constitutional Court declares the compensation cap unconstitutional"},"content":{"rendered":"<p>By <a href=\"https:\/\/www.bacciardipartners.it\/en\/people\/enzo-bacciardi\/\">Enzo Bacciardi <\/a>and <a href=\"https:\/\/www.bacciardipartners.it\/en\/people\/michele-sacchi\/\">Michele Sacchi<\/a> \u2013 <a href=\"https:\/\/www.bacciardipartners.it\/en\/employment-law\/\">Labor Law Department<\/a><\/p>\n<p>With <strong>Judgment No. 118 of July 21, 2025<\/strong>, the Constitutional Court declared the partial unconstitutionality of Article 9, paragraph 1, of Legislative Decree No. 23\/2015 (the so-called Jobs Act), insofar as it provided for a maximum compensation <strong>cap of six months\u2019 salary<\/strong> for employees unlawfully dismissed by <strong>employers with fewer than 15 employees<\/strong>.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"alignleft wp-image-30571\" src=\"https:\/\/www.bacciardipartners.it\/src\/uploads\/Licenziamenti-Illegittimi-Interno-sito-Articolo-EB-970-x-720-px-2.png\" alt=\"Avv. Sacchi Michele, logo bacciardi Partners, sfondo stanza vuota in ombra, porta aperta luminosa, licenziamenti illegittimi\" width=\"432\" height=\"320\" srcset=\"https:\/\/mail.bacciardipartners.it\/src\/uploads\/Licenziamenti-Illegittimi-Interno-sito-Articolo-EB-970-x-720-px-2.png 970w, https:\/\/mail.bacciardipartners.it\/src\/uploads\/Licenziamenti-Illegittimi-Interno-sito-Articolo-EB-970-x-720-px-2-768x570.png 768w, https:\/\/mail.bacciardipartners.it\/src\/uploads\/Licenziamenti-Illegittimi-Interno-sito-Articolo-EB-970-x-720-px-2-480x356.png 480w, https:\/\/mail.bacciardipartners.it\/src\/uploads\/Licenziamenti-Illegittimi-Interno-sito-Articolo-EB-970-x-720-px-2-560x416.png 560w\" sizes=\"(max-width: 432px) 100vw, 432px\" \/><\/p>\n<h2>What changes with this ruling<\/h2>\n<p>The Court&#8217;s decision has immediate and significant effects: even small or micro employers (including those with only one employee) <strong>may now be ordered to pay compensation of up to 18 months\u2019 salary<\/strong> (i.e., half the maximum indemnity threshold provided for employers with more than 15 employees) in cases of unjustified dismissal of workers hired from March 7, 2015, onward.<br \/>\nThis ruling does not concern discriminatory or retaliatory dismissals (already covered by stronger protections) but rather <strong>unjustified dismissals under Article 3 of the Decree<\/strong>.<\/p>\n<p>The issue was raised by the Labor Judge at the Court of Livorno, who considered the provision in breach of several constitutional articles: 3 (equality), 4 (right to work), 35 (protection of work), 41 (freedom of enterprise), and 117 (compliance with international obligations, with reference to Article 24 of the European Social Charter).<\/p>\n<h2>Why the provision was declared unconstitutional<\/h2>\n<p>The Court criticized the excessively narrow range (from 3 to 6 months\u2019 salary), which prevented judges from tailoring compensation based on the actual severity of the case. According to the Court, this system violates constitutional principles because it:<\/p>\n<ul>\n<li>does not ensure <strong>adequate reparation<\/strong> in the event of job loss;<\/li>\n<li><strong>reduces the deterrent effect<\/strong> of the sanction;<\/li>\n<li>d<strong>oes not consider the true economic capacity of the business<\/strong>, which cannot be measured solely by the number of employees.<\/li>\n<\/ul>\n<h2>Consequences and critical issues<\/h2>\n<p>However, in our view, the ruling also gives rise to several issues and contradictions:<\/p>\n<ol>\n<li><strong>Disparity among workers<\/strong>: An employee hired by a small company before March 7, 2015, who is dismissed on grounds found to be factually correct but still unlawful (e.g., due to the dismissal being deemed disproportionate), may receive a maximum compensation of six months\u2019 salary. An employee hired after that date, however, may receive up to 18 months. Thus, the indemnity treatment differs drastically despite equal levels of unjustifiability.<\/li>\n<li>D<strong>isparity between large and small businesses<\/strong>: A worker from a large company (even one with hundreds of employees) could receive lower compensation than one dismissed by a microenterprise.<\/li>\n<li><strong>Lack of objective criteria<\/strong>: After the Court previously declared seniority as the sole criterion unconstitutional (Judgment No. 194\/2018), j<strong>udges now have broad discretion<\/strong> in determining compensation. There is no clear regulatory framework, and violations of these criteria cannot even be appealed to the Supreme Court (Corte di Cassazione).<\/li>\n<li><strong>Risk for microenterprises<\/strong>: For smaller businesses, <strong>the obligation to pay up to 18 months\u2019 salary may be an unsustainable burden<\/strong>, potentially causing instability in an already fragile sector.<\/li>\n<\/ol>\n<h2>The call to the legislator: new rules are needed<\/h2>\n<p>While the Constitutional Court refrained from deeply rewriting the legislation, <strong>it issued a strong call to the legislator<\/strong> to intervene. It suggested that, in addition to the number of employees, other factors such as turnover,<strong> company finances, and organizational structure<\/strong> should be considered \u2014 in line with European standards.<\/p>\n<p>The Court acknowledged that the balance <strong>between adequate compensation and economic sustainability<\/strong> is the responsibility of the legislator, but stressed that <strong>further delays are no longer acceptable<\/strong>.
